The Regulatory Public Registry only posts regulatory proposals that have impacts for business.  In certain instances, it is not in the public interest to provide information on a regulation before it is approved.  These regulations will not be posted.

Vital Statistics Information Regulation
The Vital Statistics Information Regulation is a new regulation that is required as a result of the Vital Statistics Amendment Act, 2007.  The proposed Vital Statistics Information Regulation sets out the information required to complete all registration documents, establishes the criteria for persons who may apply to the Registrar for certificates or certified copies of registration documents and lists the persons who the Registrar may give access to or provide copies of information from any register or record on file in the office of the Registrar.

Vital Statistics Ministerial Regulation
The Vital Statistics Ministerial Regulation is a new regulation that is required as a result of the Vital Statistics Amendment Act, 2007.  The proposed Vital Statistics Ministerial Regulation sets out the types of information required to complete all registration documents and the responsibilities of a hospital administrator, funeral director and registrar when collecting and processing the information.  This includes the completion and handling of documentation such as forms, burial permits, registrations in unusual circumstances, amendments of names on registration documents, proof of identity, application for services, search of registration records, certificates and fees.

Highways Development and Protection Regulation

The proposed Highways Development and Protection Regulation along with the new Highways Development and Protection Act will provide an up-to-date Legislative framework for the provincial and municipal governments to ensure human activities and development adjacent to provincial highways and major municipal roads will not cause concerns to the safe and efficient operation of the transportation network. Key features include:

  • enable the provincial government to classify and regulate provincial highways according to their function and importance: Freeway, Multi-Lane Provincial Highway, Major Provincial Highway and Minor Provincial Highway (the controlled distance for Minor Provincial Highways is reduced by 50% from the current requirements).
  • provide a consistent process and criteria for the approval of development in the highway corridor according to the functional hierarchy of the highway. of the highway.
  • simplify the provincial approval process for city transportation systems, and enhance municipal authority to deal with development adjacent to "controlled streets" designated by municipalities.
  • introduce the use of administrative penalties to deal with illegal development adjacent to provincial highways, with appeal to the Alberta Transportation Safety Board (in lieu of the more expensive and time-consuming Court process).
  • clarify the process for the approval of signs along highways and provide effective means to deal with illegal mobile billboards.

The new regulation was developed in consultation with the affected organizations including the Cities of Calgary and Edmonton, the Alberta Urban Municipalities Association, Alberta Association of Municipal District and Counties and Alberta Municipal Affairs.

Drilling Royalty Credit Regulation
In response to the global economic crisis and a slowdown in oil and gas drilling throughout the province, the Government of Alberta announced a three-point incentive program to encourage additional activity in the oil and gas sector.

One of the incentives announced is the Drilling Royalty Credit (DRC) program which will provide companies drilling new wells with $200/meter drilled royalty credit for new oil, gas or non-project oil sands wells that meet certain criteria, including being spud on or after April 1, 2009 and before April 1, 2011. Credits will be established based on royalty obligations arising in the fiscal year starting April 1, 2009 and ending March 31, 2011.

This program is intended to encourage the development of new drilling projects as well as to help free-up cash flow, and in turn, help provide access to the capital necessary for reinvestment by Alberta's oil and gas industry, generate provincial revenues that can be invested in programs that are important to Albertans and keep Albertans at work.

Temporary Employment, Contract and Part Time Training Regulation
This new regulation will clarify the eligibility conditions for persons to attend contract-funded training and part-time training.   This should not amount to any additional administrative requirements for contracted training providers or those providers who provide part-time training.   With respect to the Temporary Employment and Job Creation Regulation, a minor change is planned to ensure that those participants who are already union members, will be able to remain as union members, despite the fact that they may be participants in a job creation or temporary job creation program.

Training Provider Regulation
A new regulation will replace the Training Provider Regulation which will outline the requirements for approved training programs to be delivered by training providers.  There may be some additional requirements for some training providers but other requirements such as acceptable attendance policies will be made more flexible or be removed all together.  The goal is to have more clear and transparent requirements which better reflect the varied needs and business processes of different type of training providers (e.g. public post-secondary institutions, private vocational colleges, high schools, etc).

Renewable Fuels Standard Regulation

Renewable Fuels Standard requires that:

  1. The average annual blend for gasoline fuel sold into the Alberta market shall be at least 5 per cent ethanol from renewable sources.
  2. The average annual blend for diesel fuel sold into the Alberta market shall be at least 2 per cent biodiesel or renewable diesel.
  3. All renewable fuels used to meet the RFS must show 25 per cent fewer greenhouse gas emissions compared to the fossil fuels they replace, as determined on a life cycle basis and as compared on an energy equivalency basis.

Home Inspection Business Regulation
The Home Inspection Business Regulation is a new regulation that will require all home inspection businesses to meet minimum standards, including operational and educational requirements.  The regulation will require home inspectors to be licensed and set out the requirements that must be met in order to obtain that license.  This measure will protect consumers as at the present time, there are no professional requirements to operating in Alberta as a home inspector.

Security Services and Investigators Regulation
The Security Services and Investigators regulation will set out standards for the security industry, such as licensing, uniform and vehicle standards, screening, training, and a Code of Conduct.  The regulation will: include responsibilities for businesses and individuals in the security industry; ensure a coordinated security delivery system within the province; and, enhance the safety of all Albertans.

Film and Video Classification Regulation
This regulation and proposed statute address parental concerns regarding their children's exposure to sexual content, coarse language and violence in films shown in public theatres.  It also protects children from viewing age inappropriate material and ensures consistency of film classification across the province. It ensures parents will be able to know what they can expect from material within each classification.

Motor Vehicle and Vital Statistics Registries Accreditation and Document Handling Regulation
This Regulation will set out the training requirements for users who handle documents and perform functions on the motor vehicle and vital statistics registries and will increase security surrounding their access.  The Regulation will further set out responsibilities of these accredited users and will establish offences and penalties.

Commercial Vehicle Dimension and Weight Regulation
The proposed amendments, following discussions with British Columbia, are required to ensure compliance with the BC-Alberta Trade, Investment, and Labour Mobility Agreement (TILMA); the details appear in the attached document. Amendments are proposed as well to include provisions of the Federal/Provincial/Territorial Agreement 2008 Memorandum of Understanding on Vehicle Weight and Dimensions (attached).  The proposed amendments also reflect changes in dimensions for modern farm equipment to 30.5 metres in length and 5.0 metres in height and to increase the combined length of a truck or farm tractor towing a grain auger to 38 metres during daylight. As tridem drive trucks are regarded as a common vehicle it is proposed they also be included in the regulation.

Traceability Livestock Identification Amendment Regulation
The Traceability Livestock Identification Regulation will be amended to allow cattle owners more flexibility in identifying cattle while maintaining the integrity of the traceability system. The time period in which cattle owners must identify their animals if using the birthing start date method will also be extended. Retagging requirements will be expanded to enable more accurate recording and add flexibility to the system. Additionally, the definition of "feedlot" will be revised and feedlot recording and reporting requirements will be modified. These amendments address significant industry concerns regarding the recording and reporting of cattle identification information.

Civil Enforcement Regulation
Many retired individuals pay their monthly living expenses from their registered retirement plans (RRPs).  Currently individuals who purchased RRPs sold by a bank or credit union (non-insurance RRPs) have no creditor protection for their retirement savings.  This means a creditor will be able to recover the debt they are owed by seizing payments a debtor receives from their RRP.  This could leave some retired debtors with little to live on.

The amended regulation changes the law so that if a debtor withdraws money from their RRP the debtor will be able to retain a certain amount of that money to cover their living expenses.  Withdrawal amounts above a certain withdrawal limit will be available to creditors.  In this way, the regulation strikes a fair balance between ensuring creditors can obtain the money they are owed from debtor RRPs, while ensuring that retired debtors can maintain enough money from their RRPs for living expenses, both for themselves and their dependants.

Cemeteries Exemption Regulation
The Cemeteries Exemption Regulation lists exemptions from the application of the Cemeteries Act and sets out conditions of those exemptions. It is set to expire on November 30, 2009.

The expiry date will be extended until November 30, 2019. Further amendments will add the Historic Dunvegan Burial Site to the list of exemptions under section 3 of the regulation and will delete the Union Cemetery. (Spondin) from the Schedule of cemeteries operated by the Special Areas Board.

Application of Public Lands Act Amendment Regulation
The proposed amendments to the Application of Public Lands Act Regulation will permit Special Areas staff to manage unauthorized recreational and industrial activities on public lands; allow for reasonable recreational access onto lands held under agricultural disposition; and provide for the Minister to cancel portions of leases where the lands are not being used for the purposes for which they were leased.

Special Areas Disposition Amendment Regulation
The Special Areas Disposition Regulation is being reviewed for ongoing relevancy and necessity.  The regulation is being amended to comply with the provisions of Trade, Investment and Labour Mobility Agreement and to address matters related to corporate assignments and joint road use agreements. Securities Amendment Regulation
Fourteen non-substantive amendments to the Securities Regulation, Alberta Regulation 115/95 are being proposed to ensure that the Securities Regulation continues to remain up-to-date.  One of those amendments will update the Fees Schedule of the Securities Regulation to conform with the harmonized registration categories being adopted under the new national registration rule.  There are no changes to registrant fees being proposed.  

The national registration rule will modernize, streamline and harmonize registration categories across Canada, and is targeted for implementation in fall 2009.  The new national registration rule has been the subject of extensive consultations - with two extended public consultations in 2007 and 2008.

Pressure Equipment Safety Amendment Regulation
The Pressure Equipment Safety Amendment Regulation will adopt the 2009 edition of the Canadian Standards Association B51 Boiler, Pressure Vessel, and Pressure Piping Code. Adopting this code ensures that the most up to date technical and safety requirements for the construction and operation of boilers, pressure vessels and pressure piping are in force in Alberta.

Building Code Amendment Regulation
The Building Code Regulation must be amended to remove requirements for basic privies from the Alberta Building Code.  These requirements have instead been added to the 2009 edition of the Alberta Private Sewage Systems Standard of Practice developed by the Safety Codes Council which will be adopted by the Private Sewage Disposal Systems Amendment Regulation.

Permit Amendment Regulation
The Permit Regulation must be amended to reflect practices established by the 2009 edition of the Alberta Private Sewage System Standard of Practice developed by the Safety Codes Council which will be adopted in the Private Sewage Disposal Systems Amendment Regulation.  The amendment to the Permit Regulation will exempt basic privies that are not connected to a holding tank from requiring a permit. This change maintains consistency with permitting requirements in place when privies were regulated under the Alberta Building Code Regulation.

Private Vocational Training Amendment Regulation
As a result of amendments to the Private Vocational Training Act in 2007, the regulation needs to be updated to be consistent with the changes to the Act as well as with current financial realities. Also, certain proposed amendments will improve consumer protection for students enrolled in licensed private vocational training programs by requiring more timely refunds of tuition or registration fees, in certain circumstances and by giving the Director more authority to ask for information regarding applicants for licenses.

The Electronics Designation Amendment Regulation will expand the application of advance disposal surcharges to audio-visual, information technology, and telecommunications equipment, and to small kitchen appliances. Vehicle Equipment Amendment Regulation
The Vehicle Equipment Regulation will be amended to prohibit the operation of unsafe or improperly equipped armoured vehicles.  The amendment is required to ensure that such modified vehicles, which are unsafe to operate or do not comply with vehicle and equipment standards, would endanger other road users and therefore not allowed to be operated on roads for public safety reasons.

Private Sewage Disposal Systems Regulation
The Private Sewage Disposal System Regulation must be amended to adopt the 2009 edition of the Alberta Private Sewage System Standard of Practice developed by the Safety Code Council.  The amendment is required to ensure that the most up to date safety requirements for on-site wastewater treatment systems are in force in Alberta.  These requirements ensure that the public and environmental healthcare is maintained in the province.  The amendments will also serve to coordinate the relationship between this regulation and Alberta Environment's legislation dealing with wastewater treatment systems.
